This privacy policy (“Policy”) describes how we collect, use secure, and share personal information collected by us when you visit our websites or use our web-based application http://bhr.fyi https://bhr.fyi/dashboard that links to this Privacy Policy, exchange information with the non-fungible token (NFT) attached to real estate, or participate in other activities described in this Privacy Policy (collectively, the “BHR Services”).

By accessing and using the BHR Services, you agree to the collection, use, and disclosure of your personal information in accordance with this Policy, and you agree to the accompanying Terms of Service. Our Terms and Conditions(“Terms”) govern all use of the BHR Services and, together with the Privacy Policy, constitute your agreement with us. If you do not agree with or you are not comfortable with any part of this Policy or the Terms, please immediately discontinue access or use of our Services.

We may modify this Privacy Policy from time to time which will be indicated by changing the “Last Updated” date at the beginning of this page. We encourage you to look for updates and changes to this Policy by checking this date when you access the BHR Services.   1. PERSONAL INFORMATION WE COLLECT

    We may collect certain personal information about you and your use of the BHR Services. In this section, we will explain the types and sources of information we collect from you. The definition of personal information depends on the applicable law based on your physical location. Only the definition that applies to your physical location will apply to you under this Policy.

    • Information You Provide to Us. We collect certain types of information from you directly. The personal information you may provide to us through the BHR Services or otherwise includes:

      • Account Registration Information. We will collect certain contact information to allow you to register an account with us and to communicate with you. We will collect information such as your first and last name, your e- mail address, a password, and a crypto wallet address
      • Home Information. When you claim a home through the BHR Services, we will collect the home address and any information about your home that you voluntarily submit to us.
      • Web-Forms. We may collect your name, email address, and company name when you request information about integration or would like to get in touch with us.
      • Customer Service. When you engage with our support team, we may collect records, copies of your correspondence (including email addresses), and any additional information you choose to share with us.
    • Information We Get From Others. We may combine personal information we receive from you with personal information we obtain from these other sources:

      • Information from Identity Verification Services. When you claim a home, we will engage third-party identity verification service providers to perform KYC checks. Such third-party service providers may ask you to provide a government-issued ID or profile photo in order to validate your identity. We do not retain the KYC documents checked from such identity verification service providers.
      • Information from Third-Party Partners and Affiliates. We may collect information about you and your home from third-party partners and affiliates who build integrations utilizing the BHR Services, such as lenders, real estate brokers, appraisers, inspectors, utility providers, insurance providers, etc..
      • Publicly Available Information. We sometimes collect information from public government sources. We may collect information about your deed, sales information about homes similar to yours as well as permits, liens, or tax assessments on your home.
    • Information Automatically Collected. To the extent permitted under the applicable law, we may collect certain types of information automatically, such as whenever you access or use the BHR Services. We may collect the following types of information automatically from you:

      • Usage Data. When you access or use the BHR Services, we automatically collect log data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed, and the order of these page views, the date and time you access our servers, and other diagnostic data.

      • Device Information. When you use your desktop or mobile devices to access the BHR Services, we may be able to identify your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.


  2. COOKIES AND OTHER TRACKING TECHNOLOGIES

    We and third parties on our behalf may use cookies or similar tracking technologies, such as cookies and other similar technologies (collectively, “Tracking Technologies”) to collect personal information automatically as you interact with our the BHR Services, to help us customize your experience and optimize our user experience, including to:

    • Analyze our web traffic using an analytics package
    • Identify whether you already visited the BHR Services
    • Store information about your preferences
    • To recognize when you return to the BHR Services

    Managing Cookies and Similar Tracking Technologies
    You have the right to decide whether to accept cookies.     Analytics
    We and our third-party technology providers use third-party analytics services (such as Google Analytics) to evaluate your use of the BHR Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the BHR Services and Internet usage.     Interest-Based Advertising
    Many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (DAA) or the Network Advertising Initiative (NAI), both of which maintain websites where people can opt-out of interest-based advertising from their members.   3. HOW WE USE YOUR INFORMATION

    We use your personal information as described in this Policy for business and commercial purposes, or as disclosed to you prior to such processing taking place. We may process your personal information to:

    • Provide the BHR Services. We process your personal information to provide the BHR Services to you. For example, when you register an account and claim your home, we require certain information such as your name, home address, and payment information. We will not be able to provide you with the BHR Service without such information. Third parties such as identity verification services may also access and/or collect your personal information when providing identity verification and/or fraud prevention services.
    • Maintain Legal and Regulatory Compliance. BHR's core services are subject to laws and regulations which may require us to process your personal information in certain ways. For example, we process your personal information to fulfill our business obligations, ensure compliance with data protection laws, manage risk as required under applicable laws and regulations, or respond to requests by judicial processes or governmental agencies
    • Enforce Compliance with Our Terms, Agreements, and Policies. When you access or use the BHR Services, you are bound to our Terms. We may process your personal information for compliance purposes, such as carrying out our obligations and enforcing our Terms or other legal rights, including those arising from any contracts entered into between you and us, including or billing and collection.
    • Detect and Prevent Fraud and Security Risks. We may process your personal information to help monitor, prevent and detect fraud and abusive use of the BHR Service, monitor and verify your identity so that unauthorized users do not gain access to your information, enhance system security, and combat spam, malware, malicious activities or other security risks.
    • Provide Customer Support and Respond to Requests. We may process your personal information when you contact us, such as with questions, concerns, and feedback. We may share this information with our service providers or partners to the extent necessary to provide you with a response.
    • Provide You with Service-Related Communications. We use your personal information to send information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages. We also use personal information to communicate with you about your use of the BHR Services related to your claimed home.
    • Provide Marketing Communications. We may process your personal information or service usage information to send you marketing communications that we believe may be of interest to you, such as marketing newsletters and commercial information about the BHR Services.
    • Market Research and Development of the BHR Services. We may process your personal information and derive aggregated and statistical data to better understand the real estate market and to better understand the way you use and interact with the BHR Services, to help us improve our existing services and to build new services.
    • Personalize Your Experience. We may also process your information to personalize your experience. Please see our “Cookies and Other Similar Tracking Technologies” section above for more information. By personalization, we enable you to more easily interact with the BHR Services across platforms and devices.
    • Facilitate Corporate Acquisitions, Mergers, and Transactions. We may process any information regarding your account and your use of the BHR Services as is necessary for the context of corporate acquisitions, mergers, or other corporate transactions.
    • With Your Consent. For any other purpose disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the services or other related services requested, with your permission or upon your direction.

  4. WHY WE SHARE YOUR INFORMATION

    We share your personal information as needed to fulfill the purposes described in this Policy and as permitted by applicable law. We may disclose your personal information as described below.

    • As Required by Law. We may access, preserve, and disclose information about you if we believe doing so is required or appropriate to (a) comply with law enforcement requests and legal processes, such as a court order or subpoena; (b) comply with requests from auditors, examiners or other regulators; (c) respond to your requests; or (d) protect your, our, or others' rights, property or safety.
    • When You Request. At your request, we will share your personal information, your home information and/or any information related to the NFT to other parties you request us to share the information, such as brokers, lenders, insurance companies, or other homeowners during a transaction.
    • With our Service Providers. We may share your information with other companies who are working on our behalf to provide you with the BHR Services. The companies include technology, customer service, marketing, and information security service providers that help us improve your experience when using the BHR Services.
    • Merger or Acquisition.We may disclose and transfer information about you to buyers, service providers, advisors, potential transactional partners, or other third parties in connection with the advisors, potential transactional partners, or other third parties of a corporate transaction in which we are acquired by or merged with another company, or we sell, liquidate, or transfer all or a portion of our business or assets. ·Without Your Consent. We may disclose your personal information for any purpose with your consent.

  5. PROTECTING YOUR PERSONAL INFORMATION

    The protection and security of your personal information are important to us. We maintain technical, organizational, and procedural safeguards designed to protect your personal information from unauthorized access and misuse. Unfortunately, the transmission of information via the Internet is not completely secure. Although we strive to protect your personal information, we cannot guarantee the security of your personal information transmitted to the BHR Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the BHR Services. We encourage you to help us protect your personal information by securing your account using a strong password and using other measures available in your account to authenticate your identity prior to using the BHR Services


  6. RETENTION OF YOUR PERSONAL INFORMATION

    We will only retain your information for as long as necessary to fulfill the purposes for which we collected it, as stated in this Policy. We will cease to retain your personal information or remove the means by which the personal information can be associated with you as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal information was collected and is no longer necessary for legal or business purposes. Please note that we may still retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


  7. YOUR RIGHTS AND CHOICES

    Depending on the applicable law where you reside, you may exercise the right to access or correct your personal information that we have collected or has been previously provided to us. If you would like to exercise your rights under applicable law, please contact us at info@bhr.fyi. In your request, please make clear what personal information you would like to have access to, changed, or removed from our database. We may seek to verify your identity when we receive your privacy rights request to ensure the security of your personal information

    Do Not Track Signals. Some newer web browsers have a "Do Not Track" preference that transmits a "Do Not Track" header to the websites you visit with information indicating that you do not want your activity to be tracked. We currently do not respond to browser "Do Not Track" signals, as there is no standard for how online services should respond to such signals. As standards develop, we may develop policies for responding to do-not-track signals that we will describe in this Privacy Policy.


  8. CHILDREN

    The BHR Services are not intended for, and we do not knowingly collect personal information from, anyone under the age of 16. If you are under 16, please do not attempt to register an account, fill out our forms or send any personal information about yourself to us. If we become aware that a child under 16 has provided us with personal information, we will comply with applicable legal requirements to delete the information. If there is any personal information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent further processing of such personal information.
